    Julian Ramirez De Arellano, P.E. (CGC1528482/PE82594) acting as LOX Construction LLC was hired on 9/15/2020 to perform work on garage addition construction with the contract award of $34,200.00. The contracted work included preparing foundation and slab and pouring concrete footers and slab, erecting block walls with lintels, demolishing a part of the existing roofing, re-roofing and repairing demolition damaged area of the existing house with shingle roofing and cricket, roofing of the new garage addition. Over the course of three months from 09/18 to 12/23 in 2020, Julian took money deposits in the amount of $28,357 in excess of the value of work performed and did not fully complete construction in the two-month timeframe as specified in the contract. On 12/23/2020 Julian took the next deposits for completion of roofing, truss framing, sheathing ($5,130). On 1/5/2021 Julian attempted abandonment of construction by asking to terminate the contract and to keep all of the money that I paid to date without further obligations. After I refused to terminate, Julian on 01.08.2021 asked to pay more for him to finish and presented me what I believe was a fraudulent change order in the amount of $1,400 for ** demobilization/remobilization** - citing relocation of personnel, relocation of materials and relocation of his trailer. Upon investigation of this change order, I found that: - Julian had no personnel to relocate; he is not a roofing contractor; and the roofing stage on the existing building and owner pulled permit can only be done by a certified roofing contractor (489.113 F.S.), which Julian would need to search for and subcontract as a normal scope of work after receiving the deposit for roofing/shingles. This means that Julian would not be able to legally do this stage with his own personnel, but had to subcontract to a roofing company. - Julian did not have any construction materials to continue work on the job site or off the job site and no proof of purchase of them. The roofing materials would have to be purchased as a normal scope of work and asphalt shingle color-matched to existing house roofing, which would require communication with me within the normal scope of work. - Julians trailer throughout the construction was used to bring new material and pick up trash only. It was never kept on my property longer than needed. After completing truss installation on 22/12/2020 it was promptly removed and parked at his property. It was not relocated to any new construction site that would require pausing any other projects to bring it back. Additionally, the contract does not require me to hire his trailer and I offered to remove any trash myself. After I refused to pay for an apparently bogus change order, Julian would not return to the job site. To my understanding, no actions were performed outside of the normal scope of work that would require additional billing. The additional charge was not discussed prior as **the meeting of the minds**, therefore, I could not exercise options and decide on whether to accept it or not. Also Julian did not mention the Florida Construction Recovery Fund in the signed contract. Also Julian did not mention a 3 day cancellation period in the contract. Additionally, Julian did not put my construction fund deposits into escrow and did not send me certified mail letters every 30 days on how my construction fund money was spent (sub-contractors payments, goods, services, equipment, etc). At this moment I only have some receipts for some materials orders that were already installed. Julian did not provide any information on the licensing/certification status of his subcontractors and whether they can work on construction phases such as roofing. At present, Julian is avoiding coming to the construction site and offered to meet him somewhere on the streets to discuss paying for his change order.
